In accordance with the provisions of Articles 6-III and 19 of Law No. 2004-575 of June 21, 2004, known as the L.C.E.N. (Confidence in the Digital Economy) Act, users and visitors of the website www.frogmask.eu are hereby informed of the following legal notices.

Article 1: Presentation

These terms and conditions of sale are concluded on the one hand by the company Goodiz Sarl, whose registered office is located at 15 ter rue Ernest Cognacq, 92300 Levallois Perret, registered with the Nanterre Trade and Companies Register under number 503 004 053, hereinafter referred to as "Goodiz," and on the other hand, by any natural or legal person wishing to make a purchase via the website www.frogmask.eu, hereinafter referred to as the "buyer."

Article 2: Object

These terms and conditions of sale aim to define the contractual relations between Goodiz and the buyer and the conditions applicable to any purchase made through the online store www.frogmask.eu, whether the buyer is a professional or a consumer.

The purchase of a product through this site implies an unconditional acceptance by the buyer of these terms and conditions of sale.

These terms and conditions of sale shall prevail over any other general or special conditions not expressly agreed to by Goodiz.

Goodiz reserves the right to modify its terms and conditions of sale at any time. In such a case, the conditions applicable shall be those in force on the date of the order by the buyer.

These general terms and conditions of sale are drafted in the French language. In the event that they are translated into one or more foreign languages, only the French text shall be binding in the event of a dispute.

Article 3: Characteristics of the Goods Offered

The products offered are those listed in the catalog published on the website www.frogmask.eu. These products are offered within the limits of available stock.

The photographs in the catalog are as faithful as possible but cannot guarantee a perfect similarity with the actual product, especially regarding colors.

In the event that a supplier modifies a product, the graphic representation thereof shall not engage the seller's liability nor affect the validity of the sale.

If the buyer lacks sufficient knowledge about the products, they should contact the seller to validate their intended use or seek advice in their purchasing process.

The products sold on the website www.frogmask.eu are excluded from the scope of Regulation (EU) 2016/425 and are considered decorative artisanal products intended for private use to protect against non-extreme atmospheric conditions.

Article 4: Prices

This is an order with an obligation to pay, which means that placing an order implies payment by the buyer.

The prices listed in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

Goodiz reserves the right to change its prices at any time, with the understanding that the price listed in the catalog on the day of the order shall be the only one applicable to the buyer.

The prices indicated include shipping and delivery costs (excluding overseas departments and other European countries, which are provided upon request).

Article 5: Order

The buyer, who wishes to purchase a product, must:

  • Provide their contact details for the delivery address.
  • Make payment under the specified conditions.
  • Confirm their order and payment.

The confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment of having full knowledge of them, and waiver of the buyer's own terms and conditions of purchase or any other conditions.

All data provided and confirmed will constitute proof of the transaction. The confirmation will serve as a signature and acceptance of the operations carried out.

Article 6: Right of Withdrawal

In accordance with the provisions of the consumer code, the consumer (any person who acts for purposes that do not fall within the scope of their commercial, industrial, artisanal, or liberal activity) has a withdrawal period of 14 days from the date of delivery of their order to return any item that does not suit them and request an exchange or refund at no cost, except for the return shipping costs, which shall be borne by the buyer. For any product return within the specified time frame, the buyer must send an email to contact@frogmask.eu to arrange the return.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) to allow resale as new, accompanied by the purchase invoice. Failure to comply with this obligation will result in the non-refund of the returned product(s).

The refund of the product(s) returned within the legal time frame will be made through PayPal if the payment was made via PayPal, or to the buyer's bank account if they paid by credit card via Stripe, upon receipt of the product(s). The estimated refund time announced by these payment partners is 4 to 5 days.

Any opened filter (removed from its original packaging) cannot be returned for obvious hygiene reasons. A fee of 3 euros (including VAT) will be deducted from the refund.

Article 7: Payment Terms

Payment is due upon ordering.

Payments will be made by credit card via Stripe or through the secure Paypal system, both of which use the SSL (Secure Socket Layer) protocol, ensuring that the information transmitted is encrypted by software and that no third party can access it during transport over the network.

The buyer's account will be debited at the time of the order. Any payment not validated by the bank or recognized as fraudulent will automatically result in the cancellation of the order.

An invoice showing VAT will be automatically sent with each order confirmation to the email address provided during the buyer's account creation.

As part of the fight against online fraud, information about your order may be shared with third parties for various verification purposes.

Article 8: Deliveries

Deliveries are made to the address indicated on the order form. Goodiz cannot be held responsible for any order lost due to an incorrect address provided during order registration.

In case of partial availability of the ordered items, Goodiz may split the orders and ship the available items first, with the balance of the order shipped as soon as the products ordered by the buyer are received by Goodiz.

The risks are the responsibility of the purchaser from the moment the products leave Goodiz's premises via Colissimo or tracked letter (depending on the weight and volume of the order). Goodiz cannot be held responsible for any theft from mailboxes once the order is reported as delivered in the postal tracking.

In case of damage during transport, a motivated complaint must be made to Goodiz within three days of delivery at contact@frogmask.eu.

Delivery times are given as an indication only, and their non-compliance cannot in any case lead to an order cancellation or any other claim. If the delivery time exceeds thirty days from the order, for reasons other than force majeure, the sales contract may be terminated and the buyer refunded, or Goodiz may offer to reship the goods to the buyer free of charge.

Force majeure events are defined as events or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, and independent of the will of the parties, despite all reasonable efforts. Expressly, force majeure or fortuitous events, in addition to those usually recognized by the jurisprudence of French courts and tribunals, include war, mobilization, riots, strikes and accidents, machinery breakdowns, inability to be supplied, blocking or interruption of means of transport or supply, earthquakes, fires, storms, floods, lightning, the interruption of telecommunications networks, or difficulties inherent to external telecommunications networks beyond the control of the customers and/or any event beyond the seller's control that prevents or significantly hampers the manufacture or shipment of products.

Deliveries are made via Tracked Letter or Colissimo La Poste, and the indicative delivery times announced by the post office are on average 2 to 3 business days.

Article 9: After-Sales Service

Goodiz does not guarantee that the quality of the products, services, information, or other materials purchased or obtained by the customer will meet their expectations, or that any errors in the service will be corrected.

However, any defective product or product with manufacturing defects, despite the quality control carried out at the end of the production process, will be replaced at Goodiz's expense after acceptance thereof.

Article 10: Liability

The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be incurred for any damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service disruption, or other unintentional problems.

Article 11: Intellectual Property

No one is authorized to reproduce, exploit, redistribute, or use in any way, even in part, elements of the site, whether they are software, visual, or sound.

Article 12: Data Protection and Privacy

The personal data provided by the buyer is necessary for processing their order and issuing invoices. It may be communicated to the seller's partners responsible for execution, processing, management, and payment of orders.

In accordance with the law on information technology, files, and freedoms of January 6, 1978, personal data concerning buyers may be subject to automated processing (sending newsletters about products sold by Goodiz).
